Orphan works are works that their copyright holder is either unknown or cannot be found. Remember that these works are still under copyright protection by law. There has been attemps by the Congress to legislate their use. But as of now, there is no law that permits you to use these works freely. However, you can use these works if your use falls into the Fair Use guidelines.
